Terms of Service

These Terms of Service ("Terms") govern your access to and use of the catchai platform and services (the "Service") operated by catchai ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Account Registration
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity under your account.
- You must notify us immediately at company@catchai.live if you suspect unauthorized access to your account.
3. Service Description
catchai is an AI-powered missed call recovery platform for healthcare clinics. The Service:
- Detects missed inbound calls to your clinic's configured phone number
- Sends automated SMS or WhatsApp messages to the caller on your behalf
- Can support AI-assisted outbound callback workflows through configured providers
- Uses AI to conduct conversations and facilitate appointment bookings
- Syncs with Google Calendar only after the clinic grants OAuth permission, and uses that access to check availability and manage appointment events
- Provides a dashboard for monitoring call activity, bookings, and performance metrics
The Service is provided "as is" and we do not guarantee uninterrupted or error-free operation.
4. Free Trial
- Before checkout, new accounts may access a limited dashboard preview for onboarding and evaluation.
- When you approve a paid plan, PayPal charges the $10 one-time setup fee immediately and starts a 5-day trial of the selected plan.
- The selected monthly subscription price is charged when the 5-day trial ends unless you cancel before the first billing time shown by PayPal and in the dashboard.
- Live calling, messaging, calendar, and other provider-backed actions require an approved plan trial or paid subscription and correctly configured third-party connections.
- Provider approvals, patient consent, local law, and technical availability may limit particular actions during or after the trial.
- We reserve the right to modify or discontinue the free trial at any time.
5. Subscriptions & Payments
5.1 Plans
We offer monthly Starter, Growth, and Pro plans. Starter includes up to 100 AI minutes per usage period, Growth includes up to 250, and Pro includes up to 500 plus outbound AI callback calls. Current pricing and the controlling plan description are displayed on our website and within the dashboard.
- Included usage is a maximum allowance, not a guaranteed amount of successful calls, messages, or appointments.
- AI usage pauses when the included allowance is reached. We do not automatically charge an overage fee under the current plans.
- Features that depend on Twilio, WhatsApp, Vapi, PayPal, Google, or another provider require valid configuration and remain subject to that provider's availability, approval, pricing, and terms.
5.2 Billing
- Payments are processed through PayPal.
- Subscriptions are billed monthly from the date of purchase.
- You authorize us to charge the selected payment method for the applicable subscription fee.
- The $10 setup fee is a mandatory one-time charge collected when a plan is approved. It is separate from the recurring monthly price and is not repeated on normal renewals.
- Payment of the setup fee does not guarantee a phone number, telecom approval, or activation date; these depend on document review, country rules, inventory, and provider approval.
5.3 Refund Policy
- Refund eligibility: Payments are generally non-refundable except where a refund is required by applicable law or expressly approved by catchai.
- Setup Fees: Setup, onboarding, or custom integration fees cover work and resources deployed on your behalf and are generally non-refundable once that work begins, except where required by law.
- Subscription Fees: Recurring subscription fees are generally non-refundable, and we do not ordinarily provide prorated refunds for mid-month cancellations, except where required by law.
- Chargebacks & Disputes: Initiating a chargeback or payment dispute with your bank or credit card company for a valid charge is a violation of these Terms. We reserve the right to dispute the chargeback, suspend your account immediately, and pursue collections for owed balances.
5.4 Cancellation
- You may cancel your subscription at any time from your dashboard or by contacting support.
- Upon cancellation, your access continues until the end of the current billing period.
- We do not provide partial refunds for unused days within a billing cycle.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Send spam, unsolicited messages, or harassment through our platform
- Attempt to bypass security measures, rate limits, or access controls
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Use the Service to collect personal data of individuals without their consent
- Misrepresent AI-generated messages as being sent by a human without disclosure
- Impersonate another person or entity
- Upload malicious code, viruses, or harmful content
- Transmit Protected Health Information (PHI) unless a Business Associate Agreement (BAA) is signed with us.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice or refund.
7. AI & Automated Communications
- The Service uses artificial intelligence (OpenAI) and voice agents (Vapi) to generate automated responses to callers via SMS, WhatsApp, and Voice.
- AI-generated responses are designed to be professional and helpful but may occasionally produce inaccurate or inappropriate content.
- You are responsible for reviewing and configuring the AI responses and appointment booking settings for your clinic.
- catchai is not liable for any medical advice, misdiagnosis, or clinical decisions influenced by AI-generated communications.
- It is your responsibility to ensure compliance with local regulations (such as TCPA or HIPAA) regarding automated and AI-assisted communications in healthcare settings.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described therein.
9. Intellectual Property
- The Service, including its design, code, branding, and content, is the intellectual property of catchai.
- You retain ownership of all data you upload or generate through the Service (clinic information, patient contact data, etc.).
- You grant us a limited license to use your data solely for the purpose of providing and improving the Service.
10. Third-Party Services
The Service integrates with third-party providers including Twilio, OpenAI, Supabase, PayPal, and Vapi. Your use of these integrations is subject to their respective terms. We are not responsible for the availability, accuracy, or practices of third-party services.
11. Limitation of Liability
To the maximum extent permitted by law:
- catchai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
- We are not liable for missed calls, failed message deliveries, AI errors, or third-party service outages beyond our reasonable control.
12. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify and hold harmless catchai, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Termination
- We may suspend or terminate your account at any time for violation of these Terms.
- You may terminate your account by contacting company@catchai.live.
- Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
